The Royal Commission into Victoria’s Mental Health System made 488 separate recommendations aimed at transforming Victoria’s mental health system. The Commission work can be characterised as a vision for the realisation of the highest attainable standard of health and mental health. This chapter explores the right to the highest attainable standard of health and mental health in international human rights law. It assesses its manifestation in the new vision for a mental health system in Victoria set out by the Royal Commission and provides an analysis of future directions for mental health law reform based on the right to mental health.
